Heard learned counsel for the petitioner and learned A.G.A. for the State- respondents. 2. This writ petition has been filed to set aside the First Information Report dated 26.8.2021 giving rise to Case Crime No. 191 of 2021, under Section 174A of I.P.C., Police Station - Bhadohi, District -Bhadohi. 3. Basing his arguments on the judgment of this Court in Criminal Misc. Writ Petition No. 17568 of 2023 (Sumit and another vs. State of U.P. and 2 others) dated 8.1.2024, learned counsel for the petitioner states that in the light of the prohibition incorporated in Section 195 of Cr.P.C., the first information report could not have been lodged. 4. Learned A.G.A. submitted that it would hardly make any difference whether the case was initiated on the basis a first information report or on the basis of a complaint. 5. Having heard the learned counsel for the parties, we are of the view that definitely the first information report could not have been lodged. The case of the petitioner is squarely covered by the case of Sumit and another vs. State of U.P. and 2 others in Criminal Misc. Writ Petition No. 17568 of 2023. The First Information Report dated 26.8.2021 giving rise to Case Crime No. 191 of 2021, under Section 174A of I.P.C., Police Station - Bhadohi, District -Bhadohi, is thus quashed. 6.
