Singha for the petitioners, (1). Abdulla Ahmed, (2). Sahjahan Ali, (3). Usman Ali, (4). Rahmat Ullah Ahmed, (5). Arif Ahmed, (6). Safiullah and (7). Izaz Ahmed. The petitioners have filed this application under Section 482 of the BNSS, 2023 with a prayer for pre-arrest bail as they are apprehending arrest in connection with Dhing P.S. Case No. 265/2024 under Sections 330(1)/117(2)/303(2)/351(2)/3(5) of the BNS. 2. Heard learned Addl. Public Prosecutor Mr. K. K. Das for the respondent State and learned counsel Mr. J. C. Borah for the informant. 3. It is submitted that a scuffle arose relating to an incident when a goat entered into the informant’s premises and started eating plants. There was an incident of assault and Ainul Haque and Mainul Haque sustained grievous injuries on their head. The injuries were caused by sharp weapon. 4. Learned Additional Public Prosecutor has raised objection stating that there are incriminating materials in the Case Diary against the petitioners. 5. I have also scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the petitioners. 6. The petitioners namely, (1). Abdulla Ahmed, (2). Sahjahan Ali, (5). Arif Ahmed, (6). Safiullah and (7). Izaz Ahmed are on interim bail. They have appeared before the Investigating Officer and their statements have been recorded. The petitioners have not violated any bail conditions. Interim bail is hereby made absolute as it appears that custodial interrogation may not be required as investigation has progressed substantially. 7. On the other hand, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioner Nos. (3). Usman Ali, and (4). Rahmat Ullah Ahmed. Hence, petitioner No. 3 and 4’s bail prayer stands rejected Page No.# 4/4 at this stage. 8. Send back the Case Diary. JUDGE Comparing Assistant
