Through the instant petition as cast under Articles 226/227 of the Constitution of India, a prayer is made for issuance of a mandamus upon the respondents to issue disability certificate to the petitioner, who met with a non fatal accident due to high voltage of electricity. 2. On an earlier occasion, this Court vide order dated 21.04.2025 directed the State counsel to inform this Court about the legal impediment for assessing the disability of the petitioner. 3. Today, learned State counsel, on instructions from Mr. Ajay, Health Department, Jind, informs this Court that the petitioner is in fact required to appear before Neuro Surgeon Department, PGIMS Rohtak, for his disability assessment. He further submits that in case any date is fixed by this Court and the petitioner causes appearance before the auhority (supra), the disability of the petitioner will be assessed, and after the assessment, disability certificate if required, in this regard will be issued accordingly. 4. In view of the statement made by learned State counsel, this Court deems it fit and appropriate, to dispose of the instant lis, with a mandamus upon PGIMS Rohtak, to assess the disability of the petitioner, in case he appears before them on dated 14.05.2025, and after assessing the petitioner medically, a disability certificate, if required, be issued to the petitioner within a period of 15 days thereafter. 5. It is expected that the entire exercise shall be concluded within one month from passing of this order. 6. Disposed of accordingly.
