The petitioners apprehend their arrest in a case registered for the offence under Sections363, 366(A)/34 of the Bhartiya Nyaya Sanhita. 3. The prosecution case, in brief, is that on 25.05.2024 at about 04:00 A.M., the niece of informant went outside for natural call, but she did not return and on search, informant saw that all the accused persons named in F.I.R including these petitioners forcefully taking away his niece in Bolero van. 4. Learned counsel for the petitioners (in both cases) submits that petitioners are innocent and have committed no offence.
Specific accusation of taking away niece of informant is against Pranav Haldar and petitioner (in Cr.Misc. No. 56272 of 2025) is father, whereas petitioners (in Cr.Misc. No. 56360 of 2025) are uncle of co-accused Pranav Haldar. The victim, in her statement recorded under Section 164 Cr.P.C., has denied the factum of kidnapping and has not supported the prosecution case and has categorically stated that she went with co-accused Pranav Haldar out of her own sweet will and solemnized marriage with him. Considering the statement of victim recorded under Section 164 Cr.P.C. and clean antecedent, both anticipatory bail petitions are allowed. Let the petitioner(s), as named above in both cases, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bagaha, West Champaran in connection with Semra P.S.
