The present petition came to originate from a proceeding in a civil suit on file of the Judge, Small Causes Srinagar in which the respondent-Hameed Paveen happened to be the plaintiff and the petitioner Showkat Ahmad Malik the defendant. 2. The said suit came to suffer dismissal for non- prosecution during the pendency of the present petition. 3. For seeking restoration of the suit, the respondent/plaintiff-Hameeda Parveen is said to have filed an application for restoration which is pending adjudication. 4. In view of the fact that the lis out of which the present petition came to originate is no more subsisting, as such, the present petition is also rendered infructuous. 5. However, in case the suit filed by the respondent/plaintiff-Hameeda Parveen gets restored to its original number by an order of the trial court of Judge Small Causes, Srinagar, then the petitioner/defendant- Showkat Ahmad Malik would be well within his right to lay a motion to this Court for seeking revival of the present petition as that would bring back the matter for examination of the impugned order passed in the civil suit by the trial court forming subject matter of present petition. 6.
