HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 13689 of 2025 Court No. - 5 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri Aniruddh Pandey, learned counsel for petitioners and Mrs. Himkanya Srivastava, learned Standing Counsel for State-Respondents.
2. Petitioners have admittedly appeared in last recruitment of U.P. Police Constable in the year 2021 and were failed. Thereafter in the years 2022, 2023 and 2024 no recruitment process was initiated by U.P. Police Recruitment and Promotion Board and now in the year 2025 by Advertisement dated 12.08.2025 recruitment process is initiated and in advertisement candidates of all categories have granted as a one time exemption of three years in terms of Government Order dated 26.05.2025 taking note that last recruitment was of the year 2020-21 and the present recruitment is commenced in the year 2024-25.
3. In view of above, the claim of petitioners that they may be granted further relaxation in age of one year has no legal basis since the decision taken by respondents is not arbitrary rather is a rational decision. The Court also takes note that Supreme Court has also left the issue of relaxation of age on the concerned respondent by an order dated 22.03.2022 passed in SLP (Civil) No. 16073-74 of 2021. In absence of any arbitrariness or being against of any law, a policy decision cannot be interfered.
