2 before the learned trial Court, and charges have already been framed. However, till date, no prosecution witness has been examined. Counsel submits that culmination of trial is likely to take considerable time, therefore, prays for the grant of bail to the petitioner. 3. On the other hand, learned State counsel, while not disputing that petitioner is in custody since 23.01.2025, opposes the prayer for bail. It is submitted that petitioner is a habitual offender and is involved in four other cases of a similar nature. Learned State counsel further contends that offences of this nature are on the rise in society, and releasing petitioner on bail at this stage would not only undermine the gravity of the offence but may also embolden others similarly placed. Therefore, prays for dismissal of present petition. 4. Having heard learned counsel for the parties and upon perusal of the material available on record, it is evident that all the offences alleged in the present case are triable by the Court of Magistrate. Petitioner is in custody since 23.01.2025, and as of now, no prosecution witness has been examined and trial is likely to take considerable time to conclude. Moreover, charges framed against petitioner are yet to be proved beyond reasonable doubt during the course of trial. In view of the totality of the circumstances, including the period of incarceration already undergone and the stage of trial, this Court is of the considered opinion that a case for grant of bail is made out.
