JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 2 21-02-2025 Heard Mr. Brij Kishor Mishra, learned counsel for the petitioner and Mr. Dilip Kumar No.1, learned APP for the State. 2. The petitioners seek bail in a case registered for the offence punishable under Sections 191(3), 190, 118(1), 118(2), 109, 103(1) of the B.N.S.. 3. As per the prosecution case, the petitioners along with other co-accused persons assaulted the informant and his brothers. One brother of the informant, namely, Raj Kumar Tiwari died during the course of treatment. 4. Learned counsel for the petitioners submits that Patna High Court CR. MISC. No.4058 of 2025(2) dt.21-02-2025 2/2 no such occurrence as alleged ever took place. They are quite innocent and have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that there is no specific overt act against the petitioners. He further submits that there is specific allegation is against co-accused, Aman Tiwari. Similarly situated co-accused has been enlarged on bail by this Court vide order dated 22.01.2025 passed in Cr. Misc. No. 80316 of 2024. The petitioners have no criminal antecedent and has been languishing in custody since 16.12.2024. 5. Learned APP for the State opposed the bail petition. 6. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jalalpur P.S.
