Heard Sri Shashi Bhushan Mishra, learned counsel for the petitioner and Sri A.K.Maurya, learned Advocate holding breif of Sri Siddharth Singhal, learned counsel for the respondent. Learned counsel for the petitioner submits that petitioner who has participated in the written examination held pursuant to the advertisement issued by U.P. Subordinate Services Selection Commission dated 12th July, 2023 for the post of Eye Testing Officer, in which though he did find place in the select list but could not appear for document verification on the scheduled dates i.e. between 21st August, 2025 and 26th August, 2025 because he was suffering from typhoid and hence he could not make even representation. It is submitted that soonafter a recovery petitioner submitted a representation on 1st September, 2025 for giving another opportunity for document verification, but no decision has been taken by respondent no. 3. Sri Maurya on contrary submits that there was sufficient opportunity available to the candidates even if they could not participate and had they made representation on 26th August, 2025, their document verification would have been permitted later in the day of 26th August, 2025 itself. However, on a pointed query being made as to whether final select list has been published or not, Mr. Maurya could not state with conformity. Versus Counsel for Petitioner(s) : Omanshi Dwivedi, Shashi Bhushan Mishra Counsel for Respondent(s) : C.S.C., Siddharth Singhal Amit Mishra .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) In the given facts and circumstances, in my considered view if petitioner has already found place in the select list and only document verification has to be made and the respondents have not yet published final select list after document verification , he should be given an opportunity of 48 hours to present himself for document verification. In this regard, petitioner is directed to make representation within three days from today and thereafter respondent no. 3 shall be taking decision in view of the observations as made above.
