JUDGMENT (Judgment of this Court was delivered by C.V. KARTHIKEYAN, J.) The Writ Appeal had been filed questioning the order dated 29.01.2025 of a learned Single Judge in W.P.(MD)No.16093 of 2023. 2.The Writ Petition had been filed in the nature of a Certiorarified Mandamus seeking records relating to the proceedings, dated 26.04.2023 issued by the District Collector, Sivagangai and the consequential proceedings dated 28.04.2023 issued by the District Collector at Chengalpattu and to quash the same and direct the respondents to permit the petitioner/appellant to retire from service with effect from

W.A.(MD)No.2563 of 2025 3.The brief facts are that the respondent herein was working as a Special Tashildar and was visited with a charge memo dated 26.04.2023. The respondent was implicated in a criminal case in Cr.No.3 of 2022 registered by the Sivagangai Rural Police Station on 31.05.2022 for offenses punishable under the provisions of the Prevention of Corruption Act, 1988. A charge memo was issued on 26.04.2023. The respondent was placed under suspension on 27.04.2023, when she was about to retire from service on attaining the age of superannuation on 30.04.2023. The second order was passed dated 28.04.2023 not permitting her to retire from service. 4.The learned Single Judge had examined the records and found that the charge memo related to classification of land in the revenue records in the name of one SMARM.Arunachalam Chettiar. The trace of title of the said land had been examined by the learned Single Judge and it was found that the respondent had passed orders of mutation of revenue records on 30.06.2017. It was therefore observed that for the 3/6
W.A.(MD)No.2563 of 2025 delinquency which was committed on 30.06.2017, the charge memo had been issued on 26.04.2023 about four days prior to retirement on attaining the age of superannuation. 5.It was further observed that a complaint had been received by the Government and the Vigilance and Anti Corruption Department was entrusted with investigation on and from 27.05.2021. It was, therefore, held that when knowledge was available with the appellants about the nature of delinquency even in the year 2021, no explanation had been given as to why the charge memo was issued just four days prior to the date of retirement in April, 2023. 6.It is further contended that subsequent to investigation, the first information report was dropped and no further steps had been taken to file any appeal.
It is thus seen that the criminal case has not proceeded and had actually been dropped by the Vigilance and Anti Corruption Department. The charge memo had been issued after nearly five years. 4/6
W.A.(MD)No.2563 of 2025 7.We hold that the learned Single Judge had correctly held that the charge memo had been issued after considerable delay of five years without any explanation for the delay. We affirm the order of the learned Single Judge. 8.Accordingly, the Writ Appeal stands dismissed. There shall be no
order as to costs. Consequently, connected miscellaneous petition is closed.
