Applicant is in judicial custody in Case Crime No.1108 of 2022, under Sections 147, 148, 149, 307, 452, 323, 325, 504, 506, 354, 336, 427 IPC, Police Station Kotwali Manglore, District Haridwar. He has sought short term bail on the ground of heart ailment.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that the applicant has been advised Bypass Surgery and the family members propose to get him admitted in the Graphic Era Hospital, Dehradun.

A report was sought from learned State Counsel. Today, learned State Counsel has tendered for the perusal of the Court the compliance affidavit of Jail Hospital, Sub Jail, Roorkee, Haridwar.

Let it be taken on record.

This affidavit reveals that, in fact, the applicant is suffering with heart ailment, for which he has been immediately advised for some procedure, and there are other ailments also.

Without adverting further on any aspect of the matter, purely on the humanitarian ground, this Court is of the view that, the applicant may be granted short term bail for a period of six weeks from the date of his release.

Short term bail application is allowed.

Accordingly, the applicant shall be enlarged on short term bail only for a period of six weeks from the date of his release on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned. It is further
directed that, on expiry of six weeks, the applicant shall surrender before the court concerned and intimation to this effect shall also be given to this Court.
