(Oral) It is the case of the petitioner that the respondent nos. 2 & 3 got a plan of residential building approved from the authority, but they are running commercial activity in the property. 2. Heard learned counsel for the parties and perused the record. 3. At the very outset, learned counsel for the Mussoorie Dehradun Development Authority (“the Authority”) submits that it was never informed by the petitioner that in defiance of the approved plan, the property is being used by the respondent nos. 2 & 3. 4. Learned counsel for the petitioner submits that the petitioner would submit a representation before the Authority within a period of one week from today. 5. Learned counsel for the Authority submits that in case the petitioner submits the representation within one week from today, it shall be decided by the Authority within a period of three weeks thereafter. 6. The Court takes on record the statement made by the learned counsel for the Authority. 2 7. In view thereof, the writ petition is disposed of with liberty to the petitioner to make a representation before the Mussoorie Dehradun Development Authority within a period of one week from today, with further directions to the authority concerned to decide the said representation to be filed by the petitioner, within three weeks thereafter, in accordance with law.
