Prayer in the present petition, filed under Section 528 of BNSS, 2023 is for issuance of direction to respondent No.9 -Deputy Superintendent of Police, Baba Bakala Sahib, Amritsar (Rural) for summoning the record of the case i.e. report No.470-5AP dated 26.11.2024; for quashing of order No.68.Lit-Br dated 12.01.2025 (Annexure P-13) and for conducting CBI inquiry into the action of the official respondents. 2. It has been submitted by learned counsel for the petitioners that the petitioners earlier approached this Court by way of filing CRM-M- 62123-2024, which was disposed of by this Court vide order dated 11.12.2024. He submits that the impugned order dated 12.01.2025 has been passed by respondent No.3 -SSP, Amritsar (Rural). He submits that impugned order passed is totally illegal and thus, the same deserves to be set aside. He submits that respondent No.5 alongwith his associates had threatened the petitioners. He submits that the whole incident was caught in CCTV. He further submits that the impugned order passed by respondent No.3 is an ex parte inquiry and thus, the same being biased deserves to be set aside. Arora, DAG, Punjab, who is present in Court, accepts notice on behalf of the State. He has opposed the submissions made by counsel for the petitioners. 5. After hearing learned counsel for the parties, it is inferred that the petitioners earlier filed a petition bearing CRM-M-62123-2024 before this Court with similar allegations and this Court vide order dated 11.12.2024 disposed of the same directing the Senior Superintendent of Police, Amritsar (Rural) to decide the representation of the petitioners. In pursuance of the same, the impugned order has been passed by respondent No.3. A perusal of the order would show that the grievances raised by the petitioners had already been appreciated. Statements of the relevant parties were recorded. On the basis of the statements of the opposite parties and residents of the village, a detailed inquiry was conducted by DSP, Baba Bakala Sahib. The dispute has been found to be a family feud. The allegation of firing by Jatinder Singh- respondent No.5 was found to be false. Hence, the representation filed by the petitioners was rejected vide impugned order dated 12.01.2025. This Court finds no scope of interference in the same. Thus, the present petition is dismissed. However, the petitioners are at liberty to pursue their remedy as available to them under the law.
