The instant writ petition has been filed for following relief: i) to direct the learned Civil Judge (Junior Divison) Garhmukteshwar Hapur to decide 6Ga application under Order 39 Rule 1 read with Section 151 C.P.C. in Suit No. 3/2025, Dharmendra and others Vs. Vipin Kumar and others pending before learned Civil Judge (Junior Division) Garhmukteshwar Hapur within 2 months and or within specific period as fixed by this Hon'ble Court. ii) To restrain the defendants from interfering, alienating and transferring the land in dispute to any person and to not to interfere in peaceful possession of the plaintiffs/ petitioners over the land in dispute during pendency of Suit No. 3/2025, Dharmendra and others Vs. Vipin Kumar and others before learned Civil Judge (Junior Division) Garhmukteshwar, Hapur. 3. Contention of the learned counsel for the petitioners is that the aforementioned 6Ga application is pending for adjudication. They prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the Civil Judge (Junior Divison) Garhmukteshwar, Hapur to consider and decide the aforementioned application of the petitioners, in accordance with Versus Counsel for Petitioner(s) : Shivam Tiwari Counsel for Respondent(s) : Dharmendra And 2 Others .....Petitioner(s) Vipin Kumar And 7 Others .....Respondent(s) law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
