(Oral) The instant appeal is preferred against the judgment and order dated 15.07.2022, passed in Family Suit No.271 of 2017, Mayank Chaudhary Vs. Itisha Chaudhary, was instituted in the court of Family Judge, Kashipur, District Udham Singh Nagar (“the suit”), by which the petition filed by the appellant under Section 13 of the Hindu Marriage Act, 1955, seeking divorce has been rejected. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the parties submit that parties have arrived at a settlement. They have decided to stay separate. They have submitted their affidavits today alongwith miscellaneous application no.02 of 2025. Therefore, the appeal may be decided in terms of the settlement arrived at between the parties. 4. The appellant and the respondent both are personally presented today. They have admitted that they have decided to stay separate and they have settled the dispute amicably. 2 5. The respondent-Itisha Chaudhary, particularly has stated that she is agreeable to the divorce. 6. The parties have settled the dispute amicably, therefore, the appeal is decided in terms of the settlement arrived at in between the parties of which terms have been stated by the parties in their respective affidavits filed along with miscellaneous application no.02 of 2025. 7.
