The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the respondents to consider him for appointment for the post of Constable. 2. The petitioner, pursuant to Advertisement No.6/2021, applied for the post of Constable in the Technical and Support Services Cadre of Punjab Police. He applied under Scheduled Caste Category. The domain opted by the petitioner was Information Technology Services with specialization in Wireless and Telecommunications. As per prescribed eligibility criteria, the petitioner was supposed to possess Bachelors (minimum 3 years) degree in Computer Science/Electronics/ Instrumentation /Communications/Information Technology/ Mechatronics/ Computer Applications/ Data Sciences/ Computer Sciences and allied fields. The petitioner is having Bachelors Degree in Arts with Information Technology. He had studied said subject throughout his degree course. He scored requisite marks and was shortlisted for Phase-II Test. He qualified Physical Measurement Test. He has been denied appointment on the ground that he does not possess an appropriate degree. The petitioner is having Bachelors degree with Information Technology as a vocational subject, thus, he is eligible for the post. 3. The selection process commenced in 2021. Final result was declared in 2022. Multiple petitions were filed before this Court with respect to prescribed qualification. The respondent rejected degree or experience of many candidates. The matter stands settled. All the successful candidates stand selected and they have already joined service. The petitioner consciously remained dormant for 3 years and at this belated stage, is trying to doubt decision of the Recruitment Board. Every selection process has to be completed. In the absence of completion of first process, it is difficult to start second process. The petitioner is guilty of delay in approaching this Court. It is settled proposition of law that Court cannot come to rescue of fence sitters. 4. In the wake of above discussion and findings, this Court is of the considered option that present petition being bereft of merit deserves to be dismissed and accordingly dismissed.
