JUSTICE SANDEEP KUMAR ORAL ORDER 3 12-11-2025 Heard learned counsel for the petitioner, learned counsel for the opposite party no. 02 Shri Sumit Kumar Srivastava and learned APP for the State. 2. The petitioner apprehends his arrest in connection with Complaint Case No. 111 of 2008 / Tr. No. 2096 of 2025 registered for the offence under Sections 498(A), 406, 386 of the Indian Penal Code and under Sections ¾ of the Dowry Prohibition Act. 3. As per the prosecution case, the allegation against the petitioner is that after marriage, he has tortured his wife for demand of dowry. 4. It has been submitted by the learned counsel for Patna High Court CR. MISC. No.52305 of 2025(3) dt.12-11-2025 2/3 the petitioner that the petitioner is innocent and he has falsely been implicated in this case. 5. He further submits that the opposite party no. 02 has got remarried and this false case has been filed only to harass the petitioner. 6. Learned counsel for the opposite party no. 02, though has opposed the application of the petitioner but he has supported the fact that the opposite party no. 02 has remarried. 7. Considering the aforesaid facts, this application is allowed. 8. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Gopalganj/concerned Court below in connection with Complaint Case No. 111 of 2008, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS. 9. The Court below is directed to conclude the trial of the petitioner at the earliest preferably within the next six months. It is made clear that if the complainant does not support Patna High Court CR. MISC. No.52305 of 2025(3) dt.12-11-2025 3/3 in the trial, the Court will be at liberty to proceed ex-parte in the trial against the non-cooperating party. Vikas/- (Sandeep Kumar, J) U
