The present petition has been filed for a direction to respondent No.2 to decide the Reference No.161 of 2020 (East India Udyog Limited v. Assam Power Distribution Company Limited) in terms of Section 18(5) of Micro, Small and Medium Enterprises Development Act (MSMED), 2006 and also for transfer of the said proceedings from respondent No.2 to an independent arbitrator. 2. Learned counsel for the petitioner, at the outset, states that he is only pressing for direction to respondent No.2 to decide the arbitration proceedings in terms of Section 18(5) of the Act. 3. We find that on 10.12.2024, the Arbitral Tribunal has noted that it was the first date of hearing fixed before it and considering the statutory timeline prescribed by Section 18(5) of the Act, time schedule has been prescribed for filing of claims, statements, evidence etc. 4. As the Tribunal itself seems to be aware of the timeline prescribed under the Act, therefore, we find no good reason to issue any further direction. 5. The writ petition is disposed of, accordingly.
