JUSTICE BISWAJIT PALIT Order 22/09/2025 Learned Counsel Mr. Samrat Ghosh appears on behalf of the applicant and prays for relaxation of the condition of bail granted to the applicant by order dated 04.07.2025 in connection with A.B. No.46 of 2025. Learned Addl. P.P. Mr. Rajib Saha appears on behalf of the State-respondent. At this stage, Learned Counsel Mr. Ghosh has drawn the attention of this Court that by the said order the accused- applicant was asked to appear before IO on every Monday and Thursday till completion of investigation and also not to leave the jurisdiction of the Court without prior permission of the O/C of the concerned PS and further not to tamper evidence on record during the period of bail. But since the applicant is serving in Indian Army and he is to leave the station tomorrow otherwise he may face departmental proceeding, so, Learned Counsel urged for relaxation of the condition of bail granted by the said order. On the other hand, Learned Addl. P.P. Mr. Saha submitted that in absence of report from IO it would be difficult on 2 his part to submit as to whether the accused-applicant has complied with the orders of this Court or not. So, Learned Addl. P.P. urged for allowing the prosecution to submit a report in this regard on the next date. To his submission, Learned Counsel Mr. Ghosh again submitted that at least for a week his case may be considered otherwise he will be in serious trouble in his department. The accused-applicant ought to file the application much earlier considering the urgency of the nature of his job. However, for the sake of justice, an opportunity is given to the accused-applicant to proceed towards his place of posting till next date leaving his contact number and the number of his authority so as to enable the IO to make contact in case of requirement of the investigation. Till next date, the accused shall be exempted from appearing before IO and it is made clear that by the next date, the accused shall return back to the jurisdiction of the O/C of the concerned PS positively. The IO be asked to submit a report on the next date through Learned Addl. P.P. as to whether the accused has complied with the order of this Court or not. List the matter on 06.11.2025. A copy of this order be supplied to Learned Counsel for the accused-applicant and also a copy of this order be supplied to Learned Addl. P.P. for information of the IO accordingly.
