Mr. Gaurav Singh, learned counsel for the applicant, appeared through video conferencing.
2. Mr. Pankaj Joshi, learned A.G.A. for the State of Uttarakhand.

The applicant is under incarceration in connection with the FIR No.0064 of 2025 dated 06.02.2025, for the offences punishable under Sections 118(1), 351(2) and 352 of the B.N.S. 2023, registered with P.S. SIDCUL, District Haridwar. During investigation, Sections 109 and 3(5) B.N.S. 2023, have also been added against the applicant keeping in view the grave injuries in the head of the injured.
4. It is contended by learned counsel for the applicant that the applicant is the tenant of Mahendra. A quarrel broke out between Sumit S/o Mahendra, Mahendra and their neighbour Mohit Pal-injured and Sumit and Mahendra assaulted the injured Mohit Pal (brother of the complainant-Ram Kumar), in which, he got severe injuries.
5. It is contended by learned counsel for the applicant that the applicant has nothing to do with the dispute between Sumit and Mahendra with their neighbour.
6. Per contra, learned State Counsel submits that the injuries, which have been received by the injured, are grievous in nature and the injuries were received on
the head, where the fracture was found. Though, it is admitted to the learned State Counsel that role of applicant-Sonu is not connected with the assault made upon the injured-Mohit Pal.
7. Having heard the learned counsel for the parties and having gone through the contents of FIR and material available on record, this Court is of the view that at this stage, the applicant deserves to be released on bail.
8. Accordingly, the first bail application is allowed.
9. Let the applicant-Sonu, be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Magistrate concerned.
