Issue a writ order or direction in the nature of mandamus directing/commanding the respondent no. 2 to decide the stay application filed in Case No. 2405 of 2025 (C- 202514000002405), Shyam Sundar Singh Vs. Shashi Kant and others) under section 38 (4) U.P. Revenue Code-2006 within stipulated period;" 2. It is contended by learned counsel for the petitioner that against the order passed under Section 30, an appeal under Section 38(4) has been filed which is pending consideration. During pendency of the appeal, a stay application has been moved which is pending consideration. The sole prayer made is for expeditious disposal of the said stay application. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, with a direction to the respondent no. 2- Additional Commissioner (Administration), Varanasi Mandal, Varanasi to decide the stay application filed in Case No. 2405 of 2025 (C-202514000002405), Shyam Sundar Singh Vs. Shashi Kant and others) under Section 38(4) of the UP Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of two weeks from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits. September 10, 2025 A. V.
