3. This anticipatory bail application has been filed by the applicant in respect of FIR No.0139 of 2021 dated 03.04.2021, under Sections 3,5,11 of Uttarakhand Cow Progeny Act, 2007, registered at Police Station Bahadrabad, District Haridwar.
4. Learned State counsel submits that he has got instructions in the matter and as per instructions there are five criminal cases against the applicant (including the present one) of the same nature; therefore he opposes the grant of anticipatory bail to him.
5. It is contended by learned counsel for the applicant that similar charges were there against the applicant-Shahjad of ABA No.825 of 2025, Shahjad Vs. State arising out of self same FIR, but he has been granted anticipatory bail by Co- ordinate Bench of this Court despite there being one more case found registered against that applicant.
6. Since one of the accused of the FIR has already been granted anticipatory bail by a Co-ordinate Bench of this Court, in another case; therefore in order to maintain parity between the parties, this anticipatory bail application also deserves to be allowed.
7. Having considered the submission of the learned counsel for the parties and keeping in view of the facts and circumstances of the case, the present anticipatory bail application is allowed. It is directed that in the event of arrest of the applicant-Shahjad in respect of the aforesaid FIR, he
2 shall be released on anticipatory bail on his executing a personal bond and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer/Investigating Officer concerned.
