This writ petition has been filed seeking following relief :- "Direct the Learned Court of Civil Judge (S.D.) Moradabad to decide the application no. 3Ga supported with affidavit 4Ga under Order 39 Rule 2 (a) (1) CPC in Misc. Case no. 266/2025 arising out of OS no. 275/2024 (MF Ilme Tamila Society Vs. State of U.P. & others.) before the Learned Court of Civil Judge (S.D.) Moradabad forthwith, as early as possible preferably on the date fixed dated 16.09.2025. Direct the respondent no. 6, restraining from blocking Gata no. 133, a public road and way to the institute of petitioner, during pendency of the Original Suit No. 275/2024 before Learned Court of Civil Judge (S.D.) Moradabad." 3. Learned counsel for the petitioner submitted that the above- mentioned case is pending consideration since 2024, the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned case is pending, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to the Civil Judge (Senior Division), Moradabad to decide Versus Counsel for Petitioner(s) : Gopal Misra, Shiv Mangal Singh Counsel for Respondent(s) : Arun Kumar Pandey, C.S.C. Mf Iime Tamila Society Munda Pandey Tehsil And District Moradabad .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) the above-mentioned case, in accordance with law, expeditiously, preferably within six months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties as well as giving a reasonable opportunity of leading evidence in respect of their case provided there is no other legal impediment.
