Mr. Bhuwnesh Joshi, learned counsel for the applicant. 2. Mr. S.C. Dumka, learned AGA along with Ms. Sweta Dobhal, learned B.H. present for the State. 3. By means of this present C482 application, applicant has challenged the summoning order dated 25.09.2020 along with the entire proceedings of Criminal Case No.6217 of 2020, State vs. Himalayee Saini, pending in the court of learned Chief Judicial Magistrate, Haridwar under Sections 469, 509 IPC and Section 66-C of the I.T. Act, 2000 (as amended in 2008) at P.S. SIDCUL, District Haridwar. 4. After arguing for a while, learned counsel confined his prayer to the extent that the applicant may be permitted to surrender before the court concerned and his bail application may be directed to be decided. He also placed reliance upon the authority of Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and Another, reported in (2021) 10 SCC 773. For the sake of convenience, relevant portion thereof is quoted hereinbelow:- “3.Category A(e) Bail applications of such accused on appearance may be decided without the accused being taken in physical custody or by granting interim bail till the bail application is decided.” 6. In such view of the matter, present C482 application is disposed of permitting the applicant to surrender, if not already done, before the concerned 2022:UHC:8778 court on or before 12.04.2025; if any bail application is moved on his behalf, the court concerned is directed to decide the same in view of dictum of the Apex Court in the case of Satender Kumar Antil (Supra). 7.
