For Petitioner : Mr.S.Kesavan For Respondent : Mr.K.Srinivasan Senior Counsel Special Public Prosecutor CBI Cases 1/6 https://www.mhc.tn.gov.in/judis Crl.R.C.No.2118 of 2025 O R D E R This criminal revision case has been filed to set aside the order dated 02.09.2025 in Crl.M.P.No.485 of 2025 in C.C.No.1 of 2024 passed by the learned IX Additional Special Judge for CBI cases at Chennai, thereby dismissed the petition to discharge the petitioner from the case in C.C.No.1 of 2024. 2.The petitioner is arrayed as A6 in C.C.No.1 of 2024. He has been charged for the offence under Sections 120-B of IPC r/w. Sections 465, 467, 468, 471 of IPC. 3.The case of the prosecution is that the recital in the memorandum of mutual co-operation indicates that Rs.55 Lakhs was paid by A3 to A2. Further, the accounts compilation was completed and handed over by A6 to A1 by fabrication of accounts. After completion of investigation, the respondent filed final report and the same was taken cognizance in C.C.No.1225 of 2011 on the file of the learned Additional Chief Metropolitan Magistrate, Egmore. The petitioner filed discharge petition in Crl.M.P.No.13813 of 2021 and the said petition was dismissed by the said Court on 08.02.2023 and 2/6 https://www.mhc.tn.gov.in/judis Crl.R.C.No.2118 of 2025 aggrieved by the same, the petitioner preferred Crl.R.C.No.397 of 2023 and the said revision was dismissed by this Court on 17.07.2023. After dismissal of Crl.R.C.No.397 of 2023, the case in C.C.No.1225 of 2011 was transferred from the file the learned Additional Chief Metropolitan Magistrate, Egmore, to the file of the learned IX Additional Special Judge for CBI Cases, Chennai and re-numbered as C.C.No.1 of 2024 and pending trial, the petitioner filed discharge petition in Crl.M.P.No.485 of 2025 and the same was dismissed by the said Court on 02.09.2025. 4.Further, there are specific allegations against the petitioner to attract the charges against the petitioner. A1 and A2 approached A6 to prepare false property statement in the prescribed format of statement/ Annexure I to VI as if the assets acquired/ held/ disposed of by A1 and A2 at the beginning/ during/ end of the check period, besides their income and expenditure etc., The petitioner knowing fully well that A1 possessed assets and pecuniary resources which were disproportionate to the known source of income and A3 was well aware that a criminal case was registered by CBI against A1 for possession of disproportionate assets and knowing fully well that A2 has not received cash of Rs.55 Lakhs during the period from August, 3/6 https://www.mhc.tn.gov.in/judis Crl.R.C.No.2118 of 2025 2002 to July, 2005 from A1, A6 prepared false and fabricated documents signed A1 and A6 accounting for the claim of Rs.55 Lakhs as a source of income of A2 and A1. A3 knowing fully well that he did not part with cash of Rs.55 Lakhs to A2, signed in the fabricated document. Therefore, there is specific allegation as against the petitioner. That apart, second discharge petition is not at all maintainable and it has been filed only to drag the proceedings of the trial. 5.In view of the above, this Court finds no infirmity or illegality in the order dated 02.09.2025 in Crl.M.P.No.485 of 2025 in C.C.No.1 of 2024 passed by the learned IX Additional Special Judge for CBI cases at Chennai. This criminal revision case is dismissed. The trial Court is directed to frame charges and proceed with the trial.
