Learned A.G.A informs that notice has been served on informant but no one has turned up to oppose this bail application. The instant bail application has been filed on behalf of the applicant, Nanhe @ Babu Shah, with a prayer to release him on bail in Case Crime No. 120 of 2024, under Sections- 376-AB IPC and Section 5(M)/6 of POCSO Act, Police Station- Sheeshgarh, District- Bareilly. There are allegations against the applicant of committing the offence of rape against minor girl on 12.06.2024. Internal medical examination of victim was conducted on the same day. The doctor has noted that hymen of victim was freshly torned at 6 o'clock position. Therefore, the allegations against the applicant appears to be correct. This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage. The bail application is accordingly, rejected. The trial court is directed to conclude the trial against the applicant as expeditiously as possible as per Section 309 Cr.P.C. (new Section 346 B.N.S.S.).
