JUSTICE SANDEEP MOUDGIL Present: Mr. Arvind Bansal, Advocate for the petitioners SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Articles 226/227, of the Constitution of India for the issuance of a writ in the nature of Mandamus directing the respondents to re-fix the pension of the petitioners in the Pay Band-4(37400- 67000+8700-GP) w.e.f. 01.09.2009 in terms of Haryana Government notification dated 19.08.2009, Annexure P-7 and Notification dated 07.01.2002, Annexure P-5, and Haryana Civil Services (Revised Pension) Part-I Rules, 2009 dated 17.04.2009, Annexure P-6, with all consequential benefits including arrears and interest accrued thereupon. Learned counsel for the petitioners submits that the case of the petitioner is covered by the judgment dated 06.08.2025 passed by this Court in CWP-16483-2018 titled as “SP Sood vs. State of Haryana and Others” while putting their claim for re-fixation of the pension in the Pay Band-4(37400- MEENU 2025.09.04 18:40 I attest to the accuracy and integrity of this document CWP-24427-2025 -2- 67000+8700-GP) w.e.f. 01.09.2009 in terms of Haryana Government notification dated 19.08.2009, Annexure P-7 and Notification dated 07.01.2002, Annexure P-5, and Haryana Civil Services (Revised Pension) Part-I Rules, 2009 dated 17.04.2009, Annexure P-6. Notice of motion. On the asking of Court, Mr. Sushil Bhardwaj, Addl. AG. Haryana, accepts notice on behalf of respondent-State and assures the Court that necessary speaking order on the legal notices dated 19.02.2025 and 10.04.2025 (Annexures P-11 and P-12) in the light of CWP-16483-2018, will be passed after providing an opportunity hearing to the petitioners within a period of six weeks from today and a copy such speaking order will be supplied to the petitioners within one week thereafter.
