As per the prosecution story, the informant, daughter of the deceased alleged that her father was having Rs. 90,000/- by selling of the land and her uncle (petitioner herein) wanted his share for which, they were regularly quarreling. The informant asked her late father to get a panchayati called for an amicable settlement but before the same could take place, came to know about the killing of her father on 22.08.2024 at 06:00 AM. This led to the F.I.R. 3. Considering the changed version in the case diary, on 19.04.2025 this Court directed the Superintendent of Police, East Champaran, Motihari to look into the matter and get the Patna High Court CR. MISC. No.2989 of 2025(5) dt.27-06-2025 2/5 case investigated through the Police Officer not below the rank of Deputy Superintendent of Police and submit a report. 4. The report clearly shows that the alibi taken by the petitioner has been found to be incorrect and further the deceased family was forced to change the version in that background and considering that the role of the petitioner has been authenticated by even the SIT headed by the Deputy Superintendent of Police, in that background, the Court is not inclined to confirm the provisional bail granted to the petitioner on 19.04.2025. 6. The petitioner as such, is directed to surrender within seven days from today and the surrender certificate be filed by 09.07.2025. 7. The petition stands dismissed. 8.
