GP FOR REVENUE The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.18062 of 2013 ORDER: The present Writ Petition is filed seeking for the following relief: “to declare the action of the respondents in trying to dispossess the petitioners from peaceful possession and enjoyment of the houses bearing Door Nos. 1-682/3, 1-768, 1-682/3, 1-682/5, 1-682/4, 1-682/2, 1-168/1 and unnumbered house belong to petitioner No. 8 of S No 161 (each 0.60 Sq yards) situated in Gollapeta, H/0 Lankellapalem, Paravada Mandal, Visakhapatnam District by way of trying to demolish the houses of the petitioners without assigning any valid reason and without following due process of law”. 2. The Petitioners are eking out their livelihood by doing coolie work on daily wage basis i.e., doing labour work in a brick industry situated in Lankellapalem Village, Paravada Mandal, Visakhapatnam District. As the Petitioners are in active possession and enjoyment of the subject house sites, the Possession Certificate dated 26.02.2009 was said to have been issued in favour of the Petitioners. As the Respondent Corporation was threatening to dispossess the Petitioners and demolish their houses, the present Writ Petition was filed. 3 3. This Court vide Order dated 25.06.2013 granted interim order as under: “Respondents are directed not to interfere with the peaceful possession and enjoyment of the Petitioners with regard to their houses bearing Door Nos. 1-682/3, 1-768, 1-682/3, 1- 682/5, 1-682/4, 1-682/2, 1-168/1 and unnumbered house belong to petitioner No. 8 of S No 161 (each 0.60 Sq yards) situated in Gollapeta, H/0 Lankellapalem, Paravada Mandal, Visakhapatnam District” and the said order is in vogue since then. 4. In view of the facts and circumstances of the case and as stated by the learned counsel appearing for the Respondents that as no further adjudication, on facts, is required in this matter, the respondents are directed to follow the interim order granted by this Court on 25.06.2013. 5. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
