Also heard Mr. Bhaskar Sarma, learned Additional Public Prosecutor, Assam. This application has been filed under Section 482 of the BNSS, 2023 by the petitioner in connection with Garchuk P.S. Case No. 71/2025. The petitioner Shahidul Islam was granted interim bail by this court on 19.03.2025 and in Page No.# 2/2 pursuant to that order, he has already appeared before the Investigating Officer and his statement has already been recorded. I have considered the submissions made by the learned counsel for both the sides. Since the petitioner has been cooperating with the investigation, this court is of the opinion that custodial interrogation of the petitioner is not necessary. Hence, the prayer for pre-arrest bail is allowed. Accordingly, the interim order dated 19.03.2025 granted to the petitioner is made absolute. The bail application is disposed of.
