GP FOR REVENUE (AP) The Court made the following: ORDER:- Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 2. Challenging the action of the respondents in interfering with the peaceful possession and enjoyment of the petitioner in respect of the property admeasuring Ac.1.00 cents in R.S.Nos.381 and 382 of Kolamuru Gram Panchayat, Konthamuru Village, Rajahmundry to evict the petitioner from the subject property, the present writ petition is filed. 3. Learned Assistant Government Pleader for Revenue placed before the Court, copy of instructions received by him, in the case. A perusal 2 of the same would indicate that the respondents have not initiated any action for dispossession in respect of the subject land. In terms of the provisions of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, notices were issued in Form - II to the occupants of land in an extent of Ac.5.36 cents in R.S.Nos.381 and 382 of Kolamuru Village, and further reflects that no notice was issued to the petitioner and respondents did not try to evict the petitioner from the subject land. The said instructions of the Tahsildar are placed on record. 4. The writ petition is disposed of directing the respondents not to dispossess the petitioner from the subject land without recourse to law. There shall be no order as to costs.
