Heard the parties.
The petitioner has been made accused in connection with Daltonganj Sadar P.S. Case No. 37 of 2024, arising out of N.D.P.S. Case No.15 of 2024 and thereafter splitting up the case record of this petitioner as N.D.P.S. Case No.15A of 2024, for the offence registered under Sections 17/18 of N.D.P.S. Act, pending in the court of Sri Niraj Kumar Srivastav, learned Special Judge under N.D.P.S. Act, Palamau at Daltonganj.
On 24.04.2024, Daltonganj Sadar police apprehended co-accused persons from a place near By-pass Road and on search, 490 grams of opium were recovered from their joint possession.
It was submitted that petitioner was not arrested at the spot and nothing was recovered from his possession. It was further submitted that name of the petitioner has come in the confession of co-accused.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Niraj Kumar Srivastav, learned Special Judge under N.D.P.S. Act, Palamau at Daltonganj, in connection with Daltonganj Sadar P.S. Case No. 37 of 2024, arising out of N.D.P.S. Case No.15 of 2024 and thereafter splitting up the case record of this petitioner as N.D.P.S. Case No.15A of
2024.
