The case of the petitioner in nutshell is that his father, Abdul Rashid Bhat S/O Sonaullah Bhat R/O Khalpora Payeen Tehsil Tangmarg, District Baramulla, who was a defence personal in Army as Hawaldar, has been killed by the militants on 4th September, 2006, and FIR No. 06/2006 in respect of the incident was registered by the Police Station Tangmarg. That since his deceased father was the sole bread earner for the family, therefore, his grandfather submitted an application before the respondent no. 2 requesting him that he i.e., the petitioner be adjusted on compassionate grounds under SRO 43 so that he may be in a position to support his family. 02. Petitioner has, accordingly, prayed for the following reliefs:- i. Issuance of an appropriate writ of Mandamus or any other, writ, order or direction upon the respondents for directing them to grant necessary relaxation in lower age/qualification, in favour of the petitioner so that necessary orders for his appointment under SRO No. 43/94 are passed by the competent authority. ii. Issuance of an appropriate writ of Mandamus or any other writ, order or direction upon the respondents commanding them to issue orders of appointment in favour of the petitioner on compassionate grounds under SRO-43/94. 03. Heard learned counsel for the petitioner and considered his submissions. 04. It is submitted by learned counsel for the petitioner that the instant petition can be disposed of even at this threshold stage by directing the respondents to consider the case of the petitioner in the light of the grounds taken in the petition. 05. Accordingly, the instant writ petition is disposed of at this stage with the direction to the respondents to consider the case of the petitioner strictly in the light of the law and the grounds projected in the petition. 06. A copy of this order along with copy of petition and enclosed documents shall be forwarded to the respondent no. 2 for necessary action on his part.
