By this petition, the petitioner seeks transfer of Criminal Case No.2724/2024 pending before the Court of Judicial Magistrate First Class, Katghora to the Court of Judicial Magistrate First Class, Korba (C.G.). 3. From perusal of the transfer petition, it transpires that the petitioner wants to transfer Criminal Case No. No.2724/2024, which is pending before JMFC, Katghora (C.G.), from JMFC, Katghora (C.G.) to JMFC, Korba (C.G.), but both the places come under the same district, therefore, it is appropriate to approach the District and Sessions Judge, Korba for redressal of her grievance under Section 448 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred as ‘BNSS’) 3. In view of the above, learned counsel for the petitioner seeks permission of this Court to avail the said liberty. 4. Accordingly, this transfer application is dismissed as withdrawn with the liberty to the petitioner to approach the District and Sessions Judge, Korba for redressal of her grievance under Section 448 of BNSS.
