Heard Sri Shailendra Kumar Singh, learned counsel for the petitioner and Shri Rajiv Kumar Mishra, learned counsel for the informant and Ms. Divya Ojha, learned AGA appearing for the State respondents. 2. Present petition has been filed seeking quashing of the impugned first information report dated 14.06.2025, registered as case crime no.0358 of 2025, under sections 61(2), 109(1) and 351(3) BNS, 2023, Police Station Katghar, District Moradabad. 3. Learned AGA as well as learned counsel for the informant have raised a preliminary objection that the petitioner is not named in the impugned first information report. 4. We find that the present petition is not maintainable in the light of judgement of Hon'ble Apex Court passed in SLP (Criminal) No. 762 of 2020 (Hukum Chand Garg and others vs. State of U.P. and others) decided on 7.2.2022. 5. In such view of the matter, present petition is not maintainable and is accordingly dismissed, however, the petitioner is at liberty to avail the remedy as may be available to him in law.
