This application under Section 528 Bharatiya Nagarik Suraksha Sanhita (hereinafter referred to as BNSS) has been filed for quashing of entire proceedings, including cognizance/ summoning order dated 18.06.2020 as well as order dated 01.08.2024, of Criminal Case No.1874 of 2020 (State Vs. Rajkumar and others), arising out of Case Crime No.02 of 2020, under Sections 147, 436, 427, 506 I.P.C., Police Station Aurai, District Bhadohi, pending before the Court of Additional Chief Judicial Magistrate, Bhadohi Gyanpur. 3. It is submitted by learned counsel for applicant that prayer made above is not being pressed and that co-accused Subedar @ Subedar Yadav has already been granted interim relief by this Court vide order dated 17.07.2025 and similar protection may be granted to the applicant. 4. In view of aforesaid, it is directed that in case applicant appears/ surrenders before the court concerned within a period of three weeks from today and applies for bail, his bail application shall be considered and decided by the court concerned in accordance with law including the law laid down in case of Satendra Kumar Antil vs. Central Bureau of Investigation and Versus Counsel for Applicant(s) : Abhishek Sharma, Prashant Krishan Counsel for Opposite Party(s) : G.A. Rajkumar .....Applicant(s) State of U.P. and Another .....Opposite Party(s) another, 2021 SCC Online SC 922. It is further directed that for a period of three weeks from today or till applicant surrenders before the court concerned, whichever is earlier, no coercive action shall be taken against applicant in the aforesaid case. 5.
