Instant transfer petition has been preferred for transfer of Complaint Case No. 6424 of 2021 filed under Section 200 of the Cr.P.C. which is pending before the Court of learned Judicial Magistrate Class No. XII at Ranchi to the Court of learned Judicial Magistrate- 1st Class No. XXI at Jamshedpur.

Learned counsel for the petitioner has submitted that the petitioner has filed two complaint cases one being Complaint Case No. C1 1032 of 2017 before the C.J.M. Jamshedpur against O.P. No.2 and another being complaint case No. 6424 of 2021, before the Judicial Magistrate Ist Class, Ranchi against the O.P. Nos. 2 to 4 and

in both the cases the cognizance has been taken. Original Complaint Case No. 1032 of 2017 was lodged basically on these premises whereas the subsequent Complaint Case No. 6424 of 2021 was in effect for a separate cause of action although arising from the Original Complaint Case including but not limited to the factums of forgery regarding the entrusted factory unit M/s. NU Tech Chemicals at Sundernagar area in Jamshedpur. Since new evidence had come to light depicting additional forgery and new cause of action arose. Hence, second complaint case has been filed. It is further submitted that a holistic approach of the circumstances at hand is nigh impossible without the appreciation of evidence/s in both cases. Since the causes of action in both the cases are interminably interconnected, petitioner-complainant and opposite parties both are residents come under the jurisdiction of Judicial Magistrate, Jamshedpur as well as subject matter of alleged offence of forgery of statutory documents, books of accounts and misc. docs. of both the factory units located within the jurisdiction of Ld. J.M.F.C.- Jamshedpur. Hence, the complaint case No. 6424 of 2024 pending before the Judicial Magistrate F.C. XII Ranchi, may be transferred to the learned court of Judicial Magistrate, Ist Class, Ranchi at Jamshedpur.
4. On the other hand, learned counsel for the opposite parties has opposed the aforesaid prayer made by the petitioner.
5. Considering the contentions raised on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer for the petitioner.
6. Accordingly, complaint case No. 6424 of 2024 pending before the Judicial Magistrate F.C. XII Ranchi, is hereby transferred to the learned court of Judicial Magistrate, Ist Class, Ranchi at Jamshedpur.
7. Accordingly, the present transfer petition is allowed.
