Sri Mahmudul Hasan, learned counsel for the applicant, Sri Pushparaj Singh, Brief Holder for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been with a prayer to issue a direction to private opposite party no. 2 to make payment of the arrears maintenance in pursuance of order passed by Principal Judge, Family Court, Kaushambi in Maintenance Case No. 280 of 2014, under Section 125 Cr.P.C - (Smt. Akhlaque Fatima Vs. Jafar Abbas) as well as to issue direction to the Execution Court to decide the Execution Case No. 146 of 2024, Police Station Sarai Akil, under Section 147 B.N.S.S, within some specified period. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
