The writ petition is directed against the F.I.R. under Sections 190, 191(2)(3), 115(2), 117(2), 109(1) of BNS, Police Station Deoband, District Saharanpur. Briefly put the prosecution case set out in the F.I.R. is that the first informant alongwith his friends had ordered a meal at a Dhaba. The accused persons entered into an altercation with them, and thereafter attacked the party of the first informant. In the ensuing commotion emergency number of the police was dialled. Learned AGA contends that the complicity of the petitioner has been found during the course of investigation. There are eye witnesses to the incident. The medical report also corroborates the prosecution case. Prima facie and triable offence is disclosed from the F.I.R. and materials collected so far during the course of investigations.
