This writ petition has been filed with the following prayer:- "(1) Issue a order or direction in the nature of mandamus direct the Court below to decide the Recall/Restoration Application dated 09/09/2019 filed by the Respondent No.2 in case No. RST/3653/ 9127/2006-2007 and Computer Case No. T20070531030005( Radhika Devi Vs. Vishwa Nath now deceased), under section 34/35 U.P. Land Revenue Act, 1901 within stipulated period which may be fixed by this Hon'ble Court,which is pending before Respondent No.2. (Annexure No. 3 to this Writ Petition)." 2. It is contended that restoration application is pending in proceedings under Section 34/35 of the U.P. Revenue Code, 2006. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. 3. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon authority concerned to decide the restoration application dated 09.09.2019 pending in proceedings under Section 34/35 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid direction, present writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the case on merit.
