JUSTICE MITALI THAKURIA ORDER 04.04.2025 Heard Mr. U. K. Barman, learned counsel for the petitioner. Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State respondent. This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of bail to the accused/petitioner, who has been languishing in jail hazot since 03.01.2025 in connection with Sonapur P. S. Case No.01/2025, registered under Section 87 of BNS and added Section 6 of the POCSO Act. Mr. Das, learned Additional Public Prosecutor, submits that though the case was listed today for production of the Case Diary before this Court, but the I.O. has already filed Charge-Sheet in this case, vide Charge-Sheet No. 35/2025, dated 26.03.2025. In this context, Mr. Barman, learned counsel for the petitioners, submits that the present petitioners are behind the bar since 03.01.2025 and hence he prays to grant bail to the petitioner considering his length of detention. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been Charge-Sheeted, vide Charge-Sheet No. 35/2025, dated 26.03.2025, it is provided that the petitioner shall file a petition for grant of regular bail, and the learned Court below shall Page No.# 3/3 consider the same in accordance with law.
