HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 31484 of 2025 Court No. - 40 HON'BLE SARAL SRIVASTAVA, J. HON'BLE SUDHANSHU CHAUHAN, J. 1. Heard learned counsel for the petitioner and learned counsel for the respondents. 2. The petitioner is aggrieved by the incorrect demand raised by the respondent no.3-Executive Engineer, Electricity Distribution Division, Machhlilshahar, Jaunpur by order dated 19.08.2025 in respect of electricity connection of petitioner. 3. It is contended by the learned counsel for the petitioner that electricity connection of the petitioner has been installed in the year 2016 whereas Executive Engineer has recorded that arrears of electricity bill is due since 1987. It is contended that while passing the impugned order, the petitioner was not afforded any opportunity of hearing. 4. Learned counsel for the respondents submits that the order has been passed in compliance of the judgement of this Court in Writ-C No.22749 of 2025, and there is no illegality in the impugned order. 5. Be that as it may, it appears that the order dated 19.08.2025 has been passed by the respondent no.3 without hearing the petitioner. According to petitioner, his electricity connection was installed in the year 2016 whereas demand of arrears has been raised since 1987. 6. In such view of the fact, we dispose off the writ petition permitting the petitioner to file a detailed representation against the impugned order dated 19.08.2025 before the respondent no.3-Executive Engineer, Electricity Versus Counsel for Petitioner(s) : R.K. Mishra Counsel for Respondent(s) : C.S.C., Udit Chandra Raja Ram Bind .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) Distribution Division, Machhlilshahar, Jaunpur within a period of one month from today. On submitting such representation, the respondent no.3 shall consider and decide the same strictly in accordance with law after hearing the petitioner and after supplying all the materials which the respondent no.3 wants to rely upon against the petitioner within a period of two months thereafter.
