Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer to delete the name of the petitioner No.1 namely Sumitra Devi who died on 01.04.2022 during the pendency of this Cr.M.P. Hence, it is submitted that the prayer as prayed for in this interlocutory application be allowed. Considering the aforesaid facts, the prayer to delete the name of the deceased petitioner No.1 namely Sumitra Devi as proposed in this interlocutory application is allowed. Registry is directed to delete the name of the petitioner No.1 namely Sumitra Devi from the cause title of this Criminal Miscellaneous Petition and mention the word ‘deleted’ against the said deceased petitioner No.1 namely Sumitra Devi vide order dated 04.08.2025 and also directed to renumber the existing petitioner Nos.2 and 3 as petitioner Nos.1 and 2 with red ink in the cause title of this Cr.M.P. This interlocutory application is disposed of accordingly. (Anil Kumar Choudhary, J.) Cr.M.P. No.882 of 2019 Learned counsel for the petitioner seeks permission of this court to withdraw this Criminal Miscellaneous Petition with liberty to raise all the grounds taken in this Criminal Miscellaneous Petition before the appropriate court at the appropriate stage.
