ORDER The matter is listed under the caption 'for being mentioned' today at the request of the
learned counsel for the applicant.
2. The learned counsel for the applicant has brought to notice that in 5th line of paragraph 1 of the order dated 21.01.2025, it has been mistakenly typed as “counsel for the respondent" instead of “counsel for the applicant" and sought for certain other clarifications in paragraph 3 of that order, which may be rectified and necessary orders may be passed in that regard. https://www.mhc.tn.gov.in/judis
3. In view of the same, paragraphs 1 and 3 of the order dated 21.01.2025 shall be substituted as follows:-
“Mr.B.Rakesh Kumar, learned counsel has filed a counter affidavit today. He has also tendered a Demand Draft for Rs.25,00,000/- and states that the respondent is willing to pay the total sum of Rs.58,00,000/- as full and final settlement of the claim of the applicant. However, the learned counsel for the applicant would invite my attention to the Section 9 petition where the claim itself is more than Rs.73,00,000/-. However, he has no objection for the respondent approaching the applicant Company and negotiating for one time settlement in the meantime.
"3. Recording the said submission of the learned counsel for the applicant, the respondent is at liberty to approach the applicant/Company for negotiating for an amicable settlement. The demand draft of Rs.25,00,000/- (No.550939), State Bank of India, dated 13.01.2025, is handed over to the learned counsel for the applicant and the same is received as part settlement on account and without prejudice."
4. Registry is directed to carry out the said rectifications and issue corrected copy of the
