Heard the parties.
The petitioner has been made accused in connection with Kenduadih P.S. Case No. 86 of 2024, for the offence registered under Sections 109(1) & 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act, 1959, pending in the court of Ms. Nitasha Baula, learned Judicial Magistrate, 1st class, Dhanbad.
On 25.08.2024, the son of the informant was waylaid by three persons near Shiv Mandir, Gondudih. It is alleged that co-accused Chhotu Yadav fired upon the son of the informant, causing injury.
Learned senior counsel for the petitioner submitted that petitioner is neither named in the F.I.R nor he was put on T.I. Parade. It was further submitted that co-accused Satyam Kumar has been granted bail by this Court in B.A. No. 670/2025 and the case of the petitioner stands on similar footing.
Mr. Pankaj Kumar, learned P.P on behalf of the State has opposed the prayer for bail of the petitioner and submitted that he is an accused in another case.

Considering the fact that there is no cogent material against the petitioner on record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Nitasha Baula, learned Judicial Magistrate, 1st class, Dhanbad, or her successor, in connection with Kenduadih P.S. Case No. 86 of 2024.
