Sandhawalia, Chief Justice (Oral) The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator, on account of the dispute, which is arising out of a partnership deed dated 20.06.2023, as per Clause 17, which arises out of a business inter se the parties regarding liquor business. 2. The requisite notice dated 02.12.2024 (Annexure P-2) had also been served and in the reply filed on 19.09.2024 by the respondents, they had also taken a plea that they were 1 Whether the reporters of Local Papers may be allowed to see the judgment? 2 2025:HHC:28527 in the process of filing appropriate application under Section 11 of the Act for appointment of the Arbitrator. 3. The counsel for the respondent has also no objection, if the Arbitrator is appointed. 4. Resultantly, this Court is of the opinion that since the parties have agreed amongst themselves for the matter to be settled by way of arbitration, the present petition is allowed and accordingly Mr. G.D. Verma, Senior Advocate, as proposed by the petitioner, is appointed as an Arbitrator to adjudicate the dispute between the parties, after his disclosure in writing is obtained in terms of Section 11(8) of the Act and only after receipt thereof, his appointment, as an Arbitrator, shall come into force. 5. On his giving consent to arbitrate the dispute between the parties as an Arbitrator, Mr. G.D. Verma, Senior Advocate, shall enter into reference, and shall pass an award in accordance with law. 6. Copy of this order be furnished to the learned counsel for the parties and also be furnished to the learned Arbitrator. The learned Arbitrator so appointed shall be entitled 3 2025:HHC:28527 to fee as per stipulation contained in the 4th Schedule appended to the Arbitration and Conciliation Act, 1996.
