WP No. 12062 of 2025 __________ Page2 of 4 Order The petitioner has approached this Court seeking a direction to respondents 3 and 4 to implement the order dated 11.07.2007 passed by the first respondent/State Transport Appellate Tribunal, Chennai, in Appeal No.200 of 2006. 2. By the said order, respondents 3 and 4 were directed to consider the petitioner’s application for grant of a mini bus permit on its merits and in accordance with law. 3. The learned counsel for the petitioner submits that, though the order was passed on 11.07.2007, respondents 3 and 4 have not taken any steps to consider the petitioner’s application. 4. The learned Special Government Pleader appearing for the respondents has placed on record G.O.Ms.No.198, Home (Transport-I) Department, dated 28.04.2025, by which the State Government introduced a new comprehensive scheme, 2024, covering the entire State of Tamil Nadu. Under the new scheme, only certain existing permits, including permits for mini bus operators issued under the Schemes of 1997 and 1999 and permits to operate on mini bus routes formulated by the Regional Transport Authorities, are excluded. WP No. 12062 of 2025 __________ Page3 of 4 comprehensive scheme, the petitioner’s application pursuant to the order passed by the Appellate Authority cannot now be considered. 5. In view of the above, no direction can be issued to respondents 3 and 4 to implement the order passed by the Appellate Authority.
Accordingly, the Writ Petition is disposed of with liberty to the petitioner to file an application for grant of a mini bus permit under the new comprehensive scheme. If such an application is filed, the competent authority shall consider the same and pass appropriate orders in accordance with law.
