1. Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 118(1), 109, 303(2), 351(2), 352 of the B.N.S. and Section 27 of the Arms Act. 3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 20.07.2025 at 2.00 P.M., accused persons came and asked him not to plough the field. Further, Indradeo assaulted Srinivash by dabiya causing injury on head and thumb and Gurudeo along with Nikhil assaulted Gautam causing injury over his body, thereafter Ashutosh and Nitish snatched informant’s chain while Himanshu snatched chain of his nephew and Sonu along with Nikhil fired. On alarm, villagers gathered and pacify the issue and injured were taken to hospital. 4. The learned counsel for the petitioners submits that on account of dispute relating to land the petitioners have been falsely implicated in the instant case by the informant.
It is further submitted that no specific allegation of assault is alleged against petitioner nos.3 and 4, though Chandradeo is alleged to have assaulted the informant by dabiya causing injury on head and petitioner no.2 Indradeo is alleged to have assaulted Srinivash by dabiya causing injury on head, but then, injury of informant has been opined to be simple. It is next submitted that injury suffered by Srinivash is opined to be grievous. 5. Learned A.P.P. opposes the anticipatory bail application. 6. Considering the submissions made by the learned
Patna High Court CR. MISC. No.80386 of 2025(2) dt.09-12-2025 3/3 A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner no.2, Indradeo Yadav. 7. The prayer of the petitioner no.2, Indradeo Yadav for anticipatory bail stands rejected. 8. So far as other petitioners are concerned, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Chausa P. S. Case No.192 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.
