Ms. Disha Vashisth, learned counsel for the petitioner. 2. Mr. S.C. Dumka, learned A.G.A. with Ms. Sweta Badola Dobhal, learned Brief Holder for the State of Uttarakhand/ respondents. 3. By means of the present writ petition, petitioner has sought the indulgence of this Court for directing the respondents to Transfer the Investigation to another District or to an impartial agency and to ensure unbiased and expeditious investigation of FIR registered as FIR No.0240 of 2025 at P.S. Laksar under Sections 115(2), 190, 191(2), 191(3), 333, 351(2) and 352 of the B.N.S. 2023. 4. Learned State Counsel, on instruction, submits that after investigation, charge- sheet has been submitted on 26.06.2025 against the accused persons named in the FIR. 5. Learned counsel for the petitioner submits that the charge-sheet has been submitted against the accused persons named in the FIR under the lesser offences, while the offence was committed by them comes in the ambit of 109 of B.N.S.2023 (307 IPC). 6. This argument of the learned counsel for the petitioner is not considerable at 2025:UHC:6567 this stage for the reasons that even if, the charge-sheet is filed under lesser Sections, the petitioner has got opportunity to make such prayer before the learned Trial Court at the time of framing of charges otherwise after recording of evidence under Section 319 Cr.P.C. (Section 358 of B.N.S.S.). 7. In view of the above, this Court doesn’t want to interfere in the present criminal writ petition and accordingly, the same is dismissed in-limine.
