2 The Court made the following order:
The present writ petition is filed questioning the action of 4th respondent in interfering with the possession of the petitioner over the land in an extent of Ac.3.00 cents in Survey No.1129/3 of Mruthyunjayakunta Village Fields, Chinna Chowk, Kadapa Mandal, YSR Kadapa District, without following the procedure contemplated under law.
2. It is the case of the petitioner that his father was assigned the subject land on 21.05.1985. Since the date of assignment, his father was in peaceful possession and enjoyment of the subject land. It is further case of the petitioner that after demise of his father, he came into possession of the said land and since then he is enjoying the same as absolute possessor. It is further case of the petitioner that the 4th respondent without issuing any notice and without following the due process of law tried to interfere with his possession over the subject land. Questioning the said action, the present writ petition is filed.
3. This Court vide
order dated 17.03.2020
directed the respondents to maintain status quo existing as on that day. The said
order is subsisting till today.
4. During the course of hearing, learned counsel for the petitioner brought to the notice of this Court that the 4th respondent passed a resumption order on 28.12.2024 against the petitioner. Questioning the said order, the petitioner filed writ petition vide W.P.No.933 of 2025
3 and upon hearing the parties, this Court by order, dated 10.01.2025
disposed of the said writ petition directing the 4th respondent to issue advance notice to the petitioner once again and pass speaking order objectively and in accordance with law and communicate a copy of such order to the petitioner forthwith. It is further submitted by the
learned counsel for the petitioner that pursuant to the said order, the 4th respondent issued notice to the petitioner and in pursuance of the same, he appeared before the 4th respondent and submitted all the documents during the enquiry. It is further stated that the 4th respondent yet to pass order in the matter. The said factum of issuance of notice and submission of documents by the petitioner before the 4th respondent is not disputed by the learned Government Pleader for Revenue.
5. Having considered the submissions made by both the learned counsel, the present Writ Petition is disposed of directing the respondents not to interfere with the possession of the petitioner till appropriate orders are passed by the 4th respondent pursuant to the
order, dated 10.01.2025 made in W.P.No.933 of 2025. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
